1. Acceptance of Terms
By accessing or using the MEP Quality Assurance platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Description of Service
MEP QA provides automated building code compliance analysis for mechanical, electrical, and plumbing (MEP) plans. The Service analyzes uploaded PDF documents against applicable building codes and generates compliance reports.
3. User Accounts
3.1 Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
3.2 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion.
4. User Content
4.1 Ownership
You retain ownership of all documents and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited license to process, analyze, and store your content solely for the purpose of providing the Service.
4.2 Responsibility
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the right to upload the content
- Your content does not violate any laws or third-party rights
- Your content does not contain malicious code or viruses
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload content that infringes intellectual property rights
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Use the Service to transmit malware or spam
- Reverse engineer or decompile the Service
- Resell or redistribute the Service without authorization
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted or error-free
- Analysis results will be accurate or complete
- Any errors will be corrected
The compliance analysis provided by the Service is automated and may not detect all code violations. Results should be verified by qualified professionals.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEP QA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
This includes but is not limited to damages arising from:
- Reliance on analysis results
- Construction defects or code violations
- Failed inspections or permit denials
- Third-party claims
- Service interruptions or data loss
8. Professional Responsibility
You acknowledge and agree that:
- The Service is a tool to assist, not replace, professional judgment
- You remain responsible for code compliance of your projects
- You should verify all analysis results independently
- Building codes are subject to interpretation by local authorities
- Local amendments may affect code requirements
9. Indemnification
You agree to indemnify and hold harmless MEP QA and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any laws or third-party rights
10. Intellectual Property
The Service, including its design, features, and content (excluding User Content), is owned by MEP QA and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
13. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
14. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
